Interpretation of the Provisions on Administration of the Customs Direct Release of Imported Goods in the Hainan Free Trade Port

I. Policy Basis

(A) "Hainan Free Trade Port Law of the People's Republic of China;"

(B) "Measures of the Customs of the People's Republic of China for Supervision and Administration of the Hainan Free Trade Port;"

(C) "Provisions on Administration of the Customs Direct Release of Imported Goods in the Hainan Free Trade Port."

II. Policy Interpretation

(A) Background to the Issuance

Article 16 of the Hainan Free Trade Port Law of the People's Republic of China stipulates that the Hainan Free Trade Port shall implement customs clearance facilitation policies, simplifying cargo circulation processes and procedures. Except for goods legally requiring inspection and quarantine or subject to license management, goods entering the Hainan Free Trade Port shall be directly released in accordance with relevant regulations, providing convenient customs clearance services for market entities.

Article 11 of the Measures of the Customs of the People's Republic of China for Supervision and Administration of the Hainan Free Trade Port stipulates that bonded goods and "zero-tariff" goods imported through Hainan Free Trade Port's open ports shall be directly released by customs in accordance with relevant regulations, with the exception of those that legally require inspection and quarantine or are subject to license management.

(B) Scope of Application

For bonded goods and "zero-tariff" goods that directly enter the Hainan Free Trade Port through its open ports, are not subject to license management, and do not involve legally required inspection and quarantine, Customs shall grant direct release based on the consignee's choice for imported goods.

Goods qualifying for relaxed trade management measures that meet the applicable conditions are similarly eligible.

(C) Enterprise Rights and Obligations

Enterprises importing goods eligible for direct release may independently choose to import them under the "direct release" mode. They shall submit information to subordinate customs offices under Haikou Customs (excluding Sansha Customs) through the International Trade "Single Window" and must timely and truthfully fulfill obligations such as submitting ledger lists or verification lists, and cooperating with customs inspections.

Bonded goods, "zero-tariff" goods, and goods subject to relaxed trade management measures are all included to be managed under electronic ledgers. Consignees of imported goods shall complete ledger entry procedures within 14 days from the date of direct release, and the goods shall not be used prior to ledger entry.

III. Special Features and Highlights

Hainan Free Trade Port's direct release policy for imported goods simplifies import processes for non-taxable, non-inspection, and non-licensed goods, reduces enterprise declaration items, and enables rapid port clearance. It implements an efficient supervision mode for directly released goods, further optimizes port business environment, and promotes the free flow of goods, capital, technology, and other factors. This helps to enhance Hainan Free Trade Port's attraction policy advantages for attracting investment, enrich its distinctive business formats, and lay a solid policy foundation for building a high-level open free trade port.

(A) Simplified Enterprise Declaration

An innovative reduction in required submission fields is expected to save two-thirds of the time during the declaration stage, leading to tangible improvement in corporate customs clearance efficiency and a reduction in declaration costs.

(B) Expanded Policy Benefits

For "zero-tariff" and bonded goods requiring inclusion in ledger management after island-wide customs closure, enterprises are offered a policy benefit of a 14-day deferral for ledger entry. This provides important support for enterprises to expand their foreign trade development opportunities.
