I. What are the requirements for establishing the “two warehouses”?
(i) Conditions for Operating Enterprises
Enterprises operating the “two warehouses” must have legal operating qualifications and dedicated premises for goods storage.
(ii) Conditions for Warehouses
1. Compliance with customs’ layout requirements for the “two warehouses”;
2. Equipped with customs-compliant isolation and supervision facilities and other facilities necessary for operations;
3. Equipped with a customs-compliant warehouse computer management system that is networked with customs;
4. Have customs-compliant warehouse management regulations;
5. The storage area of the premises must meet the requirements for different types of customs-supervised warehouses.
II. What is the application process for establishing the “two warehouses”?
(i) Enterprise Application Submission
Applicants may apply online via the “Customs Administrative Approval Online Processing Platform” (http://pre.chinaport.gov.cn/car) or by visiting the competent customs office window. Required documents include:
(1) Application Form for Bonded Warehouse/Application Form for Export Supervised Warehouse;
(2) Location map and floor plan of the proposed bonded warehouse/export supervised warehouse;
(3) For applications to establish a consignment-repair type bonded warehouse, a repair agreement between the operator and the foreign business partner must also be submitted.
(ii) Acceptance by Competent Customs
If the application documents are complete and valid, the competent customs will accept the application. Should the application materials be incomplete or fail to conform to the legal format, the competent customs should inform the applicant of all necessary corrections at once within 5 working days.
(iii) Preliminary Review by Competent Customs
Within 20 working days from the date of accepting the application, the competent customs shall provide a preliminary opinion and submit the relevant documents to the directly affiliated customs for approval.
(iv) Approval by Directly Affiliated Customs
Within 20 working days from the date of receiving the documents, the directly affiliated customs should complete its review. For applications that meet the conditions, an approval document will be issued, valid for 1 year. For those that do not meet the conditions, the applicant should be informed of the reasons in writing.
(v) Enterprise Application for Acceptance Inspection
Enterprise should apply to the competent customs for the acceptance inspection of their bonded warehouse/export supervised warehouse within one year from the date the customs issues the approval document for such warehouse.
If an applicant enterprise fails to apply for acceptance within the stipulated period without a valid reason, or if the bonded warehouse/export supervised warehouse fails its acceptance inspection, the approval document for said bonded warehouse/export supervised warehouse should automatically becomes invalid.
(vi) Customs Review and Issuance of the “Bonded Warehouse/Export Supervised Warehouse Registration Certificate”
Only after a bonded warehouse/export supervised warehouse has passed its acceptance inspection, been registered with customs, and been issued the “Bonded Warehouse/Export Supervised Warehouse Registration Certificate” may it commence relevant operations.
