Description of content: Regulation (EU) 2022/1265 provides for a prohibition for the introduction of the Rose Rosette Virus in the Union territory, for an immediate submission of information on the suspected presence of the specified pest and of its specified vector in the Union and for rules for surveys for its presence in the Union territory.

The Regulation also provides requirements for the introduction into the Union territory of Rosa spp. plants other than seeds, originating in third countries, as well as for official checks to be conducted at their introduction into the Union.

Objective and rationale: [ ] food safety, [ ] animal health, [X] plant protection, [ ] protect humans from animal/plant pest or disease, [ ] protect territory from other damage from pests.

Nature of the urgent problem(s) and reason for urgent action: Since the adoption of Commission Implementing Decision (EU) 2019/1739, repealed by Regulation (EU) 2022/1265, no interceptions of Rosa spp. infected by the Rose Rosette virus have been reported during their introduction into, or movement within the Union territory. This supports the effectiveness of the measures provided in Decision (EU) 2019/1739. However, the virus has continued to spread in several third countries (Canada, India and the United States), whilst Rosa spp. plants are imported into the Union in increasingly high volumes, including from these three third countries.

Therefore, it is appropriate to provide urgently for those measures in this Regulation (EU) 2022/1265 to ensure continued protection of the Union territory from the Rose Rosette Virus.
