(1) Background
In order to ensure proper coordination with the "Measures of the Customs of the People's Republic of China for Supervision over Inbound and Outbound Luggage and Articles" (GACC Order No. 276, hereinafter referred to as the "Supervision Measures"), and to facilitate the declaration procedures for baggage and goods of inbound and outbound personnel, revisions have been made to the relevant content of Announcement No. 72 of 2007 from the GACC ("Announcement on Implementing New Declaration System for Inbound and Outbound Travelers at Open Ports Nationwide"), and the "Announcement of the GACC on the Declaration of Baggage and Articles for Incoming and Outgoing Passengers" has been issued.
(2) Main Contents
(I) Specify the written declaration scope
According to the relevant provisions of the "Supervision Measures," the main text of the announcement lists the specific circumstances under which incoming and outgoing passengers should make a written declaration to the Customs for baggage and articles carried.
(II) Inform about electronic filing channels
According to the relevant provisions of the "Supervision Measures," electronic declaration data holds the same validity as paper documents, and the main text of the announcement informs incoming and outgoing passengers of the channels for making electronic declarations to the Customs regarding their baggage and articles.
(III) Adjust the content of the declaration documents
1. Adjust the declaration matters on the front of the "Declaration Form of In/Outbound Passenger Luggage at the Customs of the People's Republic of China" (hereinafter referred to as the "Declaration Form") according to the content of the announcement.
2. To facilitate in/outbound passengers in fully understanding the regulations on baggage and articles, and to legally fulfill the obligations for proper declaration and taxation, the "Important Notice" on the back of the Declaration Form lists the relevant provisions on tax-free limits and quantities, regulations on carrying RMB and foreign currency in cash across borders, as well as regulations on prohibited and restricted in/outbound items.
3. To help in/outbound travelers accurately understand the relevant regulations in the "Important Notice," definitions for "frequent entry and exit passengers,""passengers making multiple trips in a single day," and "passengers making multiple trips within a short period" have been added in accordance with the "Regulations on the Levy of Tariffs, Value-Added Tax, and Consumption Tax on Inbound Goods" (Announcement No. 11 of 2024 by the Tariff Commission of the State Council) and the "Interim Measures for Administration of Carrying Foreign Currency Cash into and out of China (Huifa No. 102 [2003]).
