According to the Measures for Supervising and Administering the Inspection and Quarantine of Exit Aquatic Animals and other relevant laws, regulations and documents and in accordance with the requirements of the importing countries or regions, the General Administration of Customs implements a registration system for exit aquatic animal farms and transit sites.
I. Scope of Application
The Measures for Supervising and Administering the Inspection and Quarantine of Exit Aquatic Animals is applicable to the supervision and administration for inspection and quarantine of farmed and wild-caught exit aquatic animals. Those engaged in the breeding, fishing, transit, packaging, transportation and trade of exit aquatic animals shall comply with the Measures.
II. Registration Conditions
(I) Exit aquatic animal farms and transit sites
(1) The environmental hygiene around and inside the site is good, with no pollution sources like industrial or domestic waste, including aquatic product processing plants. The site is well-organized, with scientific zoning and clear signage;
(2) The water used for aquaculture complies with the national fishery water quality standards and they have a valid water quality monitoring or testing report issued by the relevant government authority or customs;
(3) They have facilities, equipment, and materials for breeding, packaging, epidemic prevention, feed, and drug storage that comply with inspection and quarantine requirements;
(4) They have special management systems for breeding, packaging, epidemic prevention, epidemic reporting, feed and drug storage and use, waste and wastewater treatment, personnel management, introduction of aquatic animals, etc. that meet the inspection and quarantine requirements;
(5) They are equipped with professional and technical personnel in breeding and epidemic prevention, there is a training plan for practitioners, and practitioners hold health certificates;
(6) The area and transfer capacity of the transit site shall be compatible with the number of exports.
(II) Non-open water farms and transit sites for exit edible aquatic animals
(1) The environmental hygiene around and inside the site is good, with no pollution sources like industrial or domestic waste, including aquatic product processing plants. The site is well-organized, with scientific zoning and clear signage;
(2) The water used for aquaculture complies with the national fishery water quality standards and they have a valid water quality monitoring or testing report issued by the relevant government authority or customs;
(3) They have facilities, equipment, and materials for breeding, packaging, epidemic prevention, feed, and drug storage that comply with inspection and quarantine requirements;
(4) They have special management systems for breeding, packaging, epidemic prevention, epidemic reporting, feed and drug storage and use, waste and wastewater treatment, personnel management, introduction of aquatic animals, etc. that meet the inspection and quarantine requirements;
(5) They are equipped with professional and technical personnel in breeding and epidemic prevention, there is a training plan for practitioners, and practitioners hold health certificates;
(6) The area and transfer capacity of the transit site shall be compatible with the number of exports;
(7) They have facilities that are isolated from the external environment or restrict the free access of irrelevant personnel and animals, such as separation walls, nets, fences, etc.;
(8) The aquaculture water surface of the farm shall have a certain scale. Generally, the aquaculture area in cement ponds shall not be less than 20 mu and that in earth ponds shall not be less than 100 mu;
(9) The farm shall has an independent isolation pool for introducing aquatic animals. Each breeding pond has independent water inlet and drainage channels, which are set separately.
(III) Open water farms and transit sites for exit edible aquatic animals
(1) The environmental hygiene around and inside the site is good, with no pollution sources like industrial or domestic waste, including aquatic product processing plants. The site is well-organized, with scientific zoning and clear signage;
(2) The water used for aquaculture complies with the national fishery water quality standards and they have a valid water quality monitoring or testing report issued by the relevant government authority or customs;
(3) They have facilities, equipment, and materials for breeding, packaging, epidemic prevention, feed, and drug storage that comply with inspection and quarantine requirements;
(4) They have special management systems for breeding, packaging, epidemic prevention, epidemic reporting, feed and drug storage and use, waste and wastewater treatment, personnel management, introduction of aquatic animals, etc. that meet the inspection and quarantine requirements;
(5) They are equipped with professional and technical personnel in breeding and epidemic prevention, there is a training plan for practitioners, and practitioners hold health certificates;
(6) The area and transfer capacity of the transit site shall be compatible with the number of exports;
(7) There are no specified aquatic animal diseases in the farm, transit site and packaging areas;
(8) The aquaculture water area of the farm shall not be less than 500 mu, and the number of cages for cage culture is generally not less than 20.
(IV) Exit ornamental and breeding aquatic animal farms and transit sites
(1) The environmental hygiene around and inside the site is good, with no pollution sources like industrial or domestic waste, including aquatic product processing plants. The site is well-organized, with scientific zoning and clear signage;
(2) The water used for aquaculture complies with the national fishery water quality standards and they have a valid water quality monitoring or testing report issued by the relevant government authority or customs;
(3) They have facilities, equipment, and materials for breeding, packaging, epidemic prevention, feed, and drug storage that comply with inspection and quarantine requirements;
(4) They have special management systems for breeding, packaging, epidemic prevention, epidemic reporting, feed and drug storage and use, waste and wastewater treatment, personnel management, introduction of aquatic animals, etc. that meet the inspection and quarantine requirements;
(5) They are equipped with professional and technical personnel in breeding and epidemic prevention, there is a training plan for practitioners, and practitioners hold health certificates;
(6) The area and transfer capacity of the transit site shall be compatible with the number of exports;
(7) The site is located in a non-epidemic area for aquatic animal diseases. In the past two years, there have been no aquatic animal diseases that should be reported as required by the International Organization for Animal Health (OIE) and the Ministry of Agriculture;
(8) The farm has an independent isolation pond for introducing aquatic animals and an isolation breeding pond before the exit of aquatic animals. Each breeding pond has an independent water inlet and drainage channel. The water inlet and drainage channels of the farm are separated;
(9) They have facilities that are isolated from the external environment or restrict the free access of irrelevant personnel and animals, such as separation walls, nets, fences, etc.;
(10) The area of the farm is not less than 20 mu for cement ponds and not less than 100 mu for earth ponds;
(11) The packaging water used for exporting freshwater aquatic animals must meet the drinking water standards; the packaging water used for exporting seawater aquatic animals must be clean, transparent and effectively disinfected;
(12) The farm has the ability to breed and support itself, and has aquatic animals that are suitable for the scale of breeding;
(13) It is not allowed to raise aquatic animals for food.
III. Registration Process
(I) Application submission
Applicants can apply on-site through the "one window" of customs administrative approval or submit applications through the customs administrative approval online processing platform (website: http://pre.chinaport.gov.cn/car).
(II) Application acceptance
The local customs shall make a decision to accept or reject the application within 5 days after receiving the application materials and notify the applicant in writing.
(III) Acceptance decision
After accepting the application, the local customs will conduct a comprehensive review in accordance with the statutory conditions and procedures, and make a decision on whether to approve the registration within 20 working days from the date of acceptance. If the directly affiliated customs cannot make a decision within 20 days from the date of acceptance of the application, it may be extended by 10 days with the approval of the head of the directly affiliated customs, and the applicant shall be informed of the reasons for the extension.
(IV) Issuance of decision
If the license conditions are met after review, a written decision to grant the registration license shall be made in accordance with the law, and the Registration Certificate for Inspection and Quarantine of Exit Aquatic Animal Farms/Transit Sites (hereinafter referred to as the Registration Certificate) shall be issued and reported to the General Administration of Customs.
The application for the first time, change, extension and cancellation shall be handled according to the above procedures.
IV. Cancellation of Registration
The customs shall cancel the relevant registration of a registered farm or transit site if it has any of the following circumstances:
(I) The registration validity period expires and the renewal procedures are not handled in accordance with regulations;
(II) The enterprise is terminated in accordance with the law or no longer engages in exit aquatic animal business due to suspension of production, conversion of production, bankruptcy, etc.;
(III) The registration is revoked, withdrawn or the Registration Certificate is revoked according to law;
(IV) The annual inspection failed and the rectification failed within the deadline;
(V) No aquatic animals have left the country within one year;
(VI) Registration matters cannot be implemented due to force majeure;
(VII) Other circumstances where registration should be cancelled as stipulated by inspection and quarantine laws and regulations. (Zou Chuyi)
